1. Acceptance of Terms

By accessing or using NDTVerify (the "Service") at ndtverify.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service. These Terms apply to all users, including individuals and organisations accessing the Service on behalf of a company.

2. Description of Service

NDTVerify provides an AI-powered platform for reviewing Non-Destructive Testing (NDT) procedure documents against recognised industry standards including ASNT SNT-TC-1A, ASNT CP-189, ASME Section V, API 510/570/650, ISO 9712, and related EN ISO standards. The Service accepts uploaded PDF documents and returns structured compliance reports.

NDTVerify is a review and advisory tool. It is not a certification body, accreditation authority, or regulatory agency.

3. AI-Generated Content — Disclaimer of Professional Advice

All compliance reports, findings, warnings, and recommendations produced by the Service are generated by artificial intelligence and are provided for informational and reference purposes only. Specifically:

• Reports do not constitute a formal NDT procedure approval, Level 3 certification endorsement, or legal compliance determination under any jurisdiction.
• AI-generated results may contain errors, omissions, or inaccuracies. The AI cannot account for every project-specific requirement, client specification, or jurisdictional variation.
• All reports must be independently reviewed and countersigned by a qualified NDT Level 3 / PCN Level 3 engineer before use in any formal, regulatory, contractual, or client submission.
• NDTVerify and its operators accept no liability for any decisions, losses, claims, or damages arising from reliance on AI-generated reports without independent qualified review.

4. User Accounts

You must register for an account to use the Service. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security and confidentiality of your login credentials.
• Notify us immediately of any unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts found to be in violation of these Terms.

5. Payments and Billing

Access to review services requires payment as set out on our Pricing page. By submitting a payment, you agree that:

• All charges are in US Dollars (USD) unless otherwise stated.
• Pay-per-review charges are non-refundable once a review job has been initiated and processing has begun.
• Subscription plans are billed on a recurring monthly basis. You may cancel at any time; cancellation takes effect at the end of the current billing period.
• We reserve the right to modify pricing with reasonable notice posted on the website.

6. Acceptable Use

You agree not to use the Service to:

• Upload documents containing classified, export-controlled, or illegally obtained information.
• Attempt to reverse-engineer, scrape, or reproduce the underlying AI models or review logic.
• Submit fraudulent, fabricated, or falsified NDT procedures for review with intent to misrepresent compliance status.
• Interfere with, disrupt, or place an unreasonable load on the platform infrastructure.
• Use automated tools or bots to submit documents in bulk without prior written agreement.
• Violate any applicable law or regulation.

7. Intellectual Property

All software, AI models, report templates, documentation, and content on the NDTVerify platform are the exclusive intellectual property of NDTVerify and its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes only.

You retain ownership of all documents you upload. By uploading a document, you grant NDTVerify a limited licence to process the document solely for the purpose of generating your compliance report.

8. Document Confidentiality

We treat all uploaded procedure documents as confidential. Your documents:

• Are transmitted over encrypted HTTPS connections.
• Are processed on isolated, access-controlled infrastructure.
• Are never used to train, fine-tune, or improve AI models.
• Are permanently deleted from our systems 90 days after upload.
• Are never shared with third parties except as required by applicable law.

9. Limitation of Liability

To the fullest extent permitted by applicable law, NDTVerify and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of contracts, regulatory penalties, or reputational harm, arising out of or in connection with:

• Use of or inability to use the Service.
• Reliance on any AI-generated report or recommendation without independent qualified review.
• Errors, omissions, or inaccuracies in AI-generated content.
• Unauthorised access to your account or uploaded documents.

Our total aggregate liability to you for any claim shall not exceed the total fees paid by you in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless NDTVerify and its operators from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any third-party claim resulting from your use of AI-generated reports.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure upgrades, or events beyond our reasonable control may result in temporary downtime. No refunds or credits are issued for downtime of less than 24 consecutive hours.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.
